October 19, 2026 – Boston, MA – Caldwell secured a significant procedural victory on behalf of QuantumID Technologies, Inc. d/b/a SmartKargo in a commercial dispute before the New York Supreme Court, Suffolk County.

The dispute arose from claims brought by Gio Express, Inc. concerning unpaid services, followed by SmartKargo’s counterclaims involving the alleged theft of customer merchandise while in Gio’s custody.

On August 24, 2026, Justice Carl J. Copertino granted SmartKargo’s motion to dismiss all thirteen affirmative defenses asserted by Gio against those counterclaims.

The ruling narrows the issues in dispute, allowing SmartKargo to pursue its counterclaims without having to address the dismissed defenses.

Jameson J. Pasek, Caldwell’s Director of Litigation and counsel for SmartKargo, commented:

“This was a significant procedural ruling for SmartKargo, with the Court dismissing all thirteen affirmative defenses asserted against its counterclaims. The decision meaningfully narrows the issues and, importantly, eliminates the affirmative defenses Gio pleaded to those counterclaims.”
