This surge reflects a baseline shift in how successful enterprises approach intellectual property-protected innovation and market expansion.

Modern innovators face an interesting paradox: While technological advancement has never raced at a more breakneck pace, identifying truly novel and commercially viable opportunities has become that much more challenging.

Companies must navigate a veritable avalanche of existing patents, anticipate competitor movements and identify opportunities, all while managing the risk of potential infringement — and infringement can be costly. In the U.S., for example, patent litigation costs an average of $3.5 million per patent.[2]

These challenges are particularly acute in fields like artificial intelligence, quantum computing and biotechnology, where the protected IP environment is not only crowded but ever-evolving. Over the past 10 years, the number of patent families in generative AI has grown from 733 to more than 14,000 — with over 25% of all generative AI patents published last year alone.[3] And published patent applications in the quantum computing sector in 2023 surged by 200% compared to 2021.[4]
